Episode 1218: Gad Saad
A Marketing Professor Pontificating on Gender Identity
TL;DR: Gad Saad, a marketing professor with no clinical expertise in gender identity, used this nearly three-hour episode to recycle Jordan Peterson’s debunked Bill C-16 talking points and frame transgender people as a “social contagion” — and Rogan went along for the ride.
Episode 1218 (December 19, 2018) features Gad Saad, a Lebanese-Canadian marketing professor at Concordia University. Saad’s academic specialty is the application of evolutionary psychology to consumer behavior — not gender identity, endocrinology, psychiatry, or clinical psychology.
This episode was among the 100+ JRE episodes later removed from Spotify when the platform brought the show on board.
Key Problems With This Episode
1. Bill C-16 “Compelled Speech” Misinformation
Saad testified before the Canadian Senate in 2017 against Bill C-16, which added gender identity and expression to the Canadian Human Rights Act. On this episode, he reprises the Peterson/Saad framing:
The Canadian government is going to throw you in jail for using the wrong pronoun.
What the evidence says:
- Canadian Department of Justice (2018): A spokesperson confirmed no one had been jailed for misgendering under Bill C-16. Source
- Centre for Free Expression (Toronto Metropolitan University): The bill does not criminalize misgendering as a standalone offense; it operates under existing anti-discrimination frameworks that require a pattern of deliberate, targeted discrimination in employment, housing, or services. Source
- Brenda Cossman, U. of Toronto law professor: The “compelled speech” framing is a misreading of how human rights law functions in Canada. Source
2. Treating Gender Dysphoria as a Cultural Trend
Saad frames gender-diverse identities as a fad driven by social pressure and “parasitic ideas” — a theme he later expanded into his book The Parasitic Mind.
What the evidence says:
- American Psychological Association: Gender dysphoria is a recognized clinical condition with established standards of care; gender-affirming care is associated with improved mental health outcomes. Source
- Endocrine Society (2017 Clinical Practice Guideline): Treatment protocols are evidence-based and developed by clinicians with relevant expertise. Source
- WPATH Standards of Care: Gender identity is not contagious; the increase in visibility reflects reduced stigma and access to care, not “ideological capture.” Source
3. Credentials Mismatch
Saad’s PhD is in consumer behavior / marketing from Cornell. He has not published clinical research on gender dysphoria, adolescent psychiatry, or endocrinology. Yet the entire episode treats him as an authority on these topics.
I’m an evolutionary behavioral scientist. The science is clear: there are two sexes.
This conflates sex (a biological variable with known intersex exceptions) with gender identity (a separate psychological and social construct) — a distinction routinely made by actual researchers in the field.
Joe Rogan’s Role
Rogan does not push back meaningfully on any of Saad’s claims. Specifically:
- He accepts the “compelled speech” framing of Bill C-16 without referencing the actual text of the law or any legal analysis.
- He treats Saad’s marketing credentials as if they confer authority on gender identity science.
- He laughs along with mocking characterizations of transgender people and gender-diverse identities.
- He platforms the “intellectual dark web” framing in which dissent from anti-trans rhetoric is reframed as censorship.
Rogan had access — he could have invited an actual gender clinician, endocrinologist, or trans person on to discuss the topic. He did not.
Real-World Harm
- The Peterson/Saad C-16 narrative has been cited repeatedly in U.S. state legislation targeting trans rights, despite being based on a misreading of Canadian law.
- Framing trans identity as a “parasitic idea” or social contagion contributes to a documented rise in anti-trans violence and legislation.
- Trans youth denied gender-affirming care show significantly worse mental health outcomes per peer-reviewed research. Source — JAMA Network Open (2022)
Why It Matters
A marketing professor’s opinions on gender identity carry the same epistemic weight as anyone else’s — but Rogan’s platform launders them as expertise. With ~11 million listeners per episode at the time, that reframing has consequences far beyond a podcast studio.
